Formal Hearings are conducted by a district court judge for municipal, statute and traffic civil infractions. At a formal hearing the prosecution and the defense have the option to subpoena witnesses to appear on their behalf and the judge decides responsibility based upon a preponderance of the evidence presented. Costs associated with securing witnesses are the responsibility of the party calling the witness.
Court Appointed Attorneys
Court appointed attorneys are not provided for civil infractions.
Retained attorneys should file an appearance prior to the formal hearing. The court does not send notices of hearings that were provided to the defendant before the appearance was filed. Once an appearance is filed, the court will notify the attorney of any new hearing dates.
