Formal Hearings

Formal Hearings are conducted by a district court judge for municipal, statute and traffic civil infractions. At a formal hearing the prosecution and the defense have the option to subpoena witnesses to appear on their behalf and the judge decides responsibility based upon a preponderance of the evidence presented. It is the responsibility of the defense or the prosecution to incur any costs associated with sending a witness a subpoena to testify.

Court Appointed Attorneys

Court appointed attorneys are not assigned to defendants for civil infractions, a person must obtain the assistance of a licensed attorney or represent themselves.

Retained Attorneys

Attorneys who have been retained to represent a client should submit an appearance to the court prior to or at the formal hearing. If a case has been scheduled for a formal hearing prior to counsel being retained it is the responsibility of the attorney to confer with their client as to the upcoming court date and time. Once an appearance is filed with the court, defense attorneys will be notified of any subsequent hearing dates and times.
